On 20 March 2024 Cabinet approved the Council
to enter into a new Section 75 Agreement with MPFT (Midlands
Partnership NHS Foundation Trust) to continue to provide adult
social care assessment and case management and occupational therapy
in Staffordshire.
This Section 75 includes carrying out the
Council’s statutory duties for assessment of people’s
eligible needs, determination of an appropriate support plan, and
review of people with assessed eligible needs. It also
includes:
a. Providing professional support to prevent or reduce the need for
care, including rehabilitation for people with sensory needs;
b. Assessing individuals’ mental capacity and making Best
Interest Assessments
c. Completing Mental Health Act Assessments by Approved Mental
Health Professionals (AMHPs).
d. Completing safeguarding enquiries and developing safeguarding
plans.
e. Providing Occupational Therapy assessments to enable people to
maximise their independence, for example through use of
equipment.
On 20 March 2024 Cabinet authorised the Director of Health and Care
and Director of Corporate Services, in consultation with the
Cabinet Member for Health and Care
to finalise and implement the agreement.
Officers and lawyers acting on behalf of the Council and MPFT have
now finalised the drafting of the Section 75 Agreement in line with
the key principles of the Section 75 Agreement included within the
20 March Cabinet Decision.
This decision is therefore to sign and implement the Section 75
Agreement for Adult Social Care assessment and case management
commencing April 2025
The alternative option to end the Section 75
Agreement and for the Council to provide the service directly was
not agreed by Cabinet on 20 March 2024
